Bad News…

I have recently been notified that the Assistant US Attorney, Jeffrey Finnigan has filed a motion to revoke my bail despite the fact that the ruling from the 9th circuit has not yet been finalized and there are still appeal options available to me within the 9th circuit.

In other words, The US Attorney’s office is so eager to place me back into jail that he has filed a motion stating that the court should take action to throw back into prison despite the fact that I am not accused of committing a crime, am not a safety risk in any way shape or form, and am not a flight risk. This means that despite the fact that there are appeal options still on the table, and despite the fact that the Federal Grand Jury will be in session until sometime in June, the US Attorney is eager to have you, the tax payer, flip the bill for my incarceration. As if you weren’t already upset about paying for the war in Iraq, now he wants you to pay for me to be held in prison while my case continues to make it’s way through the courts.

Does anyone have any ideas why the US Attorney feels that it is so important that I be placed back into prison immediately? Let me know… oh, and by the way – I’ll be appearing on Democracy Now tomorrow morning; I’ll try to link the clip to my site as soon as possible.

    My theory? There are two reasons they are eager to put you back in jail:

    1) To reapply and ramp up the pressure they think they are putting on you to cave in and turn over all of your video; and
    2) To make an example out of you.

    In the day and age of government-sanctioned eavesdropping and torture, why wouldn’t they use all of the power at their disposal to make one bend to their will?

    It’s truly despicable.

    Standard NeoCon strategy – if you can’t silence your opponents by outright killing them, then pauper them or incarcerate them. Very heroic. Our forefathers would be SO proud. Always terrifying to see such slime in judicial robes.

    I am sorry to say that your question is moot, because you some how still believe that your government will deal with you in a rational manner. A bit of history will reveal that at one time we lived in a country that functioned with a common law that maintained that if we all used common sense and did no one any harm and caused no controversy we were within the law. Therefore we were not “Outlaws”! However some could or would not live in that manner so our legislators made law that were “Statutory”. Knowing, that because you had a car with a speedometer that went to one hundred miles an hour you were only permitted to operate that car in a school zone at the posted (The Statute) limit. So a sign went up stating that you could only operate the car at a speed not to exceed the posting, the statute for which there were fines and penalties affixed. Now everyone was under the statute, not just the ones that lived outside the law. However when so many according to the government paid little heed to those statutes there was another modality made operational that being “Working Law” and which in point of fact says “This is the way we do it here and that is the law”! Most will never get to question the law and the “Good Ole Boys” get to run the whole show. Made up of the constabulary, Bar card lawyers, (both sides) as they only appear to be adversarial, and its from them which they get their judges. Of course throw in the legislators, and congressional pull. So where does an interloper such as yourself think he can come along and ask, and even tell the GOB’s what the law is and how it ‘tis to be appropriated? Only to find out that the GOB’s can make you an outlaw and can and will affix fines and penalties. There is another interesting phenomena that occurs during this process that those who are told that you are innocent until proven guilty, now burden you being guilty and have you attempt to prove you’re innocent. There is only one consolation in the entirety of this process is that you in your heart of hearts knows the truth and it is that which makes you free.

    I agree with what every one has said so far….I think they’re afraid of you. If you are doing this then more people will defend their rights and the U.S. attorney can’t just, like, have people standing up for their rights and shit…. Most people would have done whatever the FBI wanted out of fear or blind obedience. I think they expect it but not only did you not give them what they wanted you put up a huge fuckin fight so you’ve majorly pissed of a lot of goverment people. You have also been very out spoken and they want you under control, they think they might get that if you’re in jail. They’re also hoping to wear you out so you’ll give up.

    I can’t understand why the feds want to revoke bail. It is clear you aren’t going to turn over the tape, so as your lawyer says, it is simply punishment.

    Even worse that the judges revoked bail. Hopefully there is a way to get the full panel to overturn that before Wednesday

    Like you, I believe it is wrong for the government to investigate crimes.

    I am somewhat disheartened to find out such a big bad Anarchist is using the US court system though.

    As a freelancer myself (stills) and an NPPA member, thank you for doing what you are doing.

    According to the current interpretation(s) of the law, we have no RIGHT not to disclose that which is asked of us by the Fed, but you’re doing the right thing.

    A free press is an integral component of any democracy. By forcing subpoenas upon journalists, the government hampers the ability of the press to do its job in the name of democracy.

    So long as people like you continue to fight the good fight, no matter the cost, the media’s ability to do its job will be defended.

    Josh, I’d trade places with you if they’d let me.

    Keep your head down, your chin up, and you’ll get through it.

    Your honesty and love has touched many. The frontline is a lonely place so i can overstand your feelings of loneliness. All the prisoners of imperlism have felt the same, it’s just that old russia story is playing it self out.     Hey Josh, Thanks for fighting the good fight and not cooperating with the government. What I feel is that this country’s government will go to any length to control information in order to control public opinion. They do not want an informed and educated population because they would all be out of work in short order. Under the patriot act you are probably considered an ‘enemy combatant’ against the state/control mechanism. That is why they want to hold you in jail so they can limit your communication and work as much as they can. The unfair/unsustainable system is crumbling and government will only tighten their control, expand and abuse their power, a la patriot acts, because people like you are helping to show what really happened in that situation, not their fabricated lie of what they want the rest of society to believe what happened. This is the beginnings of the death gasps of this system and unfortunately I fear this will be happening to alot more people in the not too distant future. Control mechanism wants to quash all dissent/dissenters, anyone who does not agree with the program. They want to punish you for keeping what is rightfully yours to do with it what you will. Meanwhile, government and corporations are not held accountable for crimes against nature and humanity that are almost incomprehensible to us, but it is all in the name of ‘progress’ and all that bureaucratic, technocratic, plutocratic, oligarchic, collectivist b.s. that is going to die out because of what you are trying to do, and what we’re all tired of (ever increasing intrusion by the government into our lives, incremental deletion of liberties and rights, ever increasing legislation and regulation of all facets of our lives, encroaching fascism/corporatism) and will put an end to one way or another. It’s gonna get much uglier and deadlier shortly though I’m afraid, the ones in power have planned well and will not go quietly and will try to take out all they can with them as they go down.     You are a dolt. The Ninth Circuit rejected your appeal out of hand (look at the timing), and while there are still options for you to pursue, those options present extraordinarily slim chances. It is not the US Attorney who is imposing costs on the taxpayer, but you, by pursuing those appeals options when (a) you’re clearly (a1) wrong and (a2) a dolt and (b) they have such slim chances of success.

    Moreover, I am all for protesting. Blowing up a cop — even a bad bad piggy cop backing up the G8 conference. It’s not speech. It’s a speech-act. And the act part is given much slimmer protection by the First Amendment.

    I reiterate: Dolt.
