Judith Miller gives statement of support for Josh

Saturday, former NYT journalist, Judith Miller, unsuccessfully attempted to visit Josh in the Dublin federal jail. Currently, only family members and his attorney are allowed to see him. Miller was there to show her support for Josh and to raise awareness for his case.

” . . . I’m here to demonstrate not only my personal support . . . for his courageous stance, but also the need for a federal shield law to make sure that there can’t be an end-run around state laws as there seems to be have been in this case. I’m here to express my solidarity as a fellow journalist with him and for all people who believe in a free and independent, uncoerced and uncoercible press.”

Josh would have normally been protected from government coercion by California state shield laws. The prosecutors argue, quite ludicrously, that the damage supposedly done to the cop car during the demo makes it a federal matter.

    Judith Miller would like to take on the mantle of ‘imprisoned journalist martyr’ to try to cover the stench of her arselicking of the Bushies and her getting sucked in by Chalabi in her . Josh doesn’t need too many friends like Miller.

    This is one of the shakiest legal arguments I have ever heard. Isn’t anyone from oh, I don’t know, the state of California a little bit concerned about the federal goverment trampling state laws?

    We may as well do away with states entirely if everything is a federal matter.

    I don’t know who Judith Miller is, but I hope some other journalists will step up and speak out for Josh. My best wishes are with him and you.

    A link didn’t appear for some odd reason in my earlier comment. I was referring to Miller’s reportage on WMD which was really nothing more than the Bush/Rove party line.

    Aaron, you really should know who Judith Miller is. Miller was jailed for contempt of court, under the subterfuge of protecting her sources, doing so to cover the arses of the Bushies over her role in the exposure of the identity of CIA operative Valierie Plame.

    Rove & Cheney wanted to leak the Plame info into the press to discredit Plame’s husband, Joe Wilson IV, after Wilson wrote a scathing op-ed piece in the NY Times which told the truth about the Bushies’ false claim of Saddam Hussein having WMD.

    Miller isn’t a journalist- she’s a Bush crony. Josh needs Judy Miller like I need a second asshole. Good thing that the prison didn’t let her visit Josh. I suspect Josh would have told her to go get bent anyway.

    Federalism is a system of government which divides government power between a central national authority (Da Feds) and the states. Federalism is a very good hedge against totalitarian rule- and the framers of the US Constitution knew that very well.

    Many democratic nations around the world, including Australia, where I now live, embrace federalism for the very purpose of decentralising government power. Federalism is also under threat in Australia at the moment, however.

    Unless the feddies can prove that Josh’s actions constituted criminal activity which took place across state lines, they really won’t be able to make anything stick. Josh’s upcoming appeal of his incarceration before the 9th Circuit Court of Appeals ought to be successful, That the judge in the original case ordered Josh incarcerated for contempt is a total abuse of power.

    Protect the identities of anti-G8 demonstrators
    -and-
    Show the government that the demonstrators are not guilty of any crime (within your knowledge)

    Here is how: redact the remaining footage by placing obfuscation or black-out over the faces of the demonstrators. Give the resulting video to the grand-jury.

    If the government does not accept ‘doctored’ footage, they expose a motive to strike at peacable demonstrators. There is no way they can guarantee that any footage you would turn over is complete or not. With digital video, apparent continuity is weak evidence for actual continuity.

    The argument that obviously doctored footage is any worse than footage that may contain hidden alterations rings empty to me.

    Give it a shot.

    Its sad when things like this happen for absurd reasons, He doesnt belong in a prison that place is for killers, rapists, thiefs and other social degenerates. When prosecutors start getting journalists and other good hearted people sent to prison theres definatly something wrong with the laws there, has the US become a province of china?

    I hear two sides of the argument:
    Liberal – Journalists need to be protected, and so do their sources. The 1st Ammendment gives journalists full protection for releasing information they feel is necessary. Journalists should feel the comfort and protection of rights.
    Conservative – When information is withheld from the government, it would be considered an obstruction of justice to avoid giving leads to find out who is responsible for a crime. The Fifth Ammendment does not apply to the obstruction of justice.

    I will not say which one I hold on to.

    On one hand, “C’mon Josh, give the footage and at least work with the government to help out the officer with the fractured skull. It’s not about you or your ‘mission,’ lives are important, and justice needs to be served for hurting an officer.”

    On the other hand, what’s next? Will Roman Catholic priests, while not yet, but later on, be required to give information since Catholics are supposed to confess for penance? It may very well be a slippery slope.

    Arguments to my statement are more than welcome.

    I think you mix 2 arguments. You say that since the government would have to give its footage back to justice if anyone was the victim is true ! But that doesn’t mean that a journalist would have to do the same.

    Whose role is it to protect and defend ? Government or press ? I think press has to inform, which could eventually lead to protection and defense, but this is only secondary. It can also sometimes threat and endanger. Government has the role of protecting and defending. Government forcing people to help it do its task is a mistake… Cause now they turn to journalists… Who’s next ? You, me,… ???

    There’s a well known sentence concernig WWII, I cannot remember nor autor, nor precisely the terms used, but its sense is as follows :

    When they came for handicapped, I didn’t say anything,
    When they came for jewish, I didn’t say anything,
    When they knocked at my door, they wasn’t anyone left to hear my cries

    It is especially now time to show that we are not OK with this fascism ! It is time, because it’s only just begun, and we are enough out there to reverse the move !

    I can’t stand to see journalists or any other celebs using the plights of an incarcerated person to gain publicity of their own. It simply sickens me.
