Hi, I’m Liz Wolf-Spada, Josh’s mom. Although the July 20th hearing seemed promising, today the judge, Judge Alsop ruled against all motions including 5th amendment rights, rights coming under freedom of the press, against bail or a stay. Josh is in Dublin federal prison, in the East Bay area of the San Francisco Bay. I don’t have any other information at this time, but his lawyer is planning to file an appeal to the federal 9th circuit court. That filing alone costs almost $500, so if you can donate any little bit helps with the expenses of legal counsel and money for Josh while in jail. If you believe in prayer or good thoughts please send them to Josh. Thanks,

I would have a lot more sympathy for you, Josh, had you not publicly released portions of the tapes to suit your own agenda/viewpoint. But you did, and then you refused to share the rest of the footage, which only makes you look like a very biased and very subjective participant in the whole mess. At any rate, you clearly want to protect those anarchist protestors from facing legal charges for their actions. So I think it’s fitting that you yourself are about to get a taste of some real anarchy in prison. You want to prevent the government from enforcing the law? When you’re in the slammer, remember not to whine if/when some inmates decide to subject you to a little lawlessness as well….

I do not know the issue, because I barely skimmed the rhetoric, but you hold two disadvantages. You are young, and you foolishly believed adults, rather than questioned them. Had you learned more quickly than I, you would have used the defense which has been used by the adults who are attacking you. Your successful defense is amusingly easy, but the power of the institution of lawyers and therefore judges is predicated on keeping you ignorant of that defense. Therefore you must learn it the hard way, by asking questions, on record, and more, to teach your mind new knowledge, while you are honorably in prison.
Never again believe an adult. Instead, question them, with real questions, written, on record, and repeat the questions they refuse to answer. If you are sufficiently tenacious, you will belatedly learn how easily you could have defended yourself, and categorically defeated the government and its empire of lawyers, and laugh yourself to tears.
May you learn the most knowledge of the most concepts most efficiently.

Protecting source?!? What source? You are the source, aren’t you? You have the right to your property and can sell or share whatever part you wish. The court asked to view the original tape and did not intend to confiscate your property. You could have still kept a copy (or even the original) and it would still be your copyright. I think you have been naive and misguided in trying to protect those who have probably commited a crime.

The struggle for parity is one that we should all support, because it is a struggle for a diverse and independent press. So many major stories have been broken by online news organizations that there can no longer be a reasonable doubt about the need for online reporting and commentary. Media consolidation makes our presence even more important. We should all stand in solidarity with those who are brave and unfortunate enough to have to defend their first amendment rights from an overreaching government.

I hope that you do not suffer too much for your principles and our Constitution. If it helps, there are many including myself, who support you and your efforts. I fear it is already too late for this country, as we no longer support the efforts of the common man and instead allow corporations more rights than citizens.
I recently read that 60% of corporations do not pay taxes. The top 1% are the only ones who are benefiting from tax cuts (rebates), more people are slipping below the poverty line and cronyism is rampant.

To the rightie idiots who are a bit too excited about Josh “dropping the soap” (you people are creepy), before you completely sell out the Constitution, maybe try thinking for a change? What are the Feds doing investigating a possible arson to a San Diego PD squad car? Secondly, the Feds are trying to slip by California’s strong journalistic shield law by claiming that the cop car was paid for, in part, with federal tax dollars, and it having been “damaged” now makes that a crime worthy of a Federal Grand Jury and stomping on the rights of journalists.

Josh, and all others whom has or may have property in which our government may want. In the future just simply say “i destroyed all the tapes, cd’s etc” to avoid any possible problems. There is NO way you would have been jailed after saying that. This is what the administration has done for the past 6 years. How many times have we heard of a tape, letter, or email that could shed light on an issue, only to hear that the item was “missplaced” or “destroyed”. So next time, remember, you don’t have the item anymore! Shame on our government for putting you in jail! I hope you had an Aids test before going into the slammer, because your chances of contracting aids have gone up 92% just being in jail. If you do give over the tapes, be sure to have them sign a waiver that if ANY of the material is “leaked”, that you hold them resonsible for damages. If you want to be a citizen in this country, you need to be committed to upholding the law of the land (which is created by a representative government, and subjected to an array of checks and balances). When the government wants you to testify they ask you, if you say no is that not your right and if they want your property and its legal for you to have it, and you say no is that also not your right. So if the government which used to screw its citizens in private now does it publicly how long before you have no freedoms or rights. I would like to remind all of you, that Josh is not covering up a violent crime against a police officer, as his video was focused on where his partner was and he can’t be in two places at once. The SFPD is investigating that issue, as they should be. Why aren’t they investigating the issue of the “suppose” “attempted” arson of a police car? No police car burned, there is no record of that happening and as you can see in the video on this site, colored smoke bombs were lit, four days after the fourth of July. If we lose a free press, we as a citizenry will lose the constitutional amendments our forefathers fought so hard for over 200 years ago.
While there is a Federal Correctional Institution (FCI) in Dublin, it houses female offenders. Males are housed in one of the “pods” of Alameda County’s Santa Rita Jail.
I spent one night there about 10 years ago. I was supposed to be housed in the federal pod, but there wasn’t room and I was put into one of the county pods for my short stay.
My experience was that the facility is modern, clean, and relatively safe. Like Josh will probably feel, I was very much out of my element.

The 18 pods are clearly visible, surrounding central recreation areas. I was only there for about 14 hours, but there were guys playing basketball (in their orange jump suits and flimsy prison slippers) outside for some of the time.
The guards are pretty much invisible, housed in glass observation areas and interacting with the detainees through speakers and microphones.
The room I was in held one other guy, with a door, not bars.
There are two tiers that are released in shifts for meals (and probably other activities).
I am not at all a tough guy, and I did not fear for my safety while I was there.
It is very likely that detainees in the federal pod are slightly better off then those I saw.

Journo or not, the original film is his own. Indeed, I’d have given one free copy to the courts, & permitted copyright upon written requests.

You have every legal right as a journalist, who was publishing/broadcasting his material not to turn over the tape to a criminal investigation. In order to require you to turn over the tapes you have to have a) some collusive connection and b) something not already witnessed. Neither of these criteria have been substantially proved. Freedom from unreasonable search and seizure is essential for America.

Keep it up, my friend. As both a blogger, and working member of the group most courts call “the media” i.e., someone with credentials working for a media company, I’ve often come across the situation you’ve faced here. The truth is that if we give our tape to the prosecutors and others upon subpoena, we become defacto members of the police department, not members of the media. As to those who seem to want to argue about the definition of “journalist” — just remember that you who shout loudest about “no special rights” for journalists make it so that in this country anyone can report, write and contribute. Yes, so does the First Amendment. The PD need to release the details of the alleged crimes in question — if they don’t, how will they know if they can or cannot obtain the same information from another source? Look over the past Supreme Court cases, and you’ll see the current test that prevents fishing expeditions. In the meantime, you’re doing what many “real journalists” never have to — standing up for both freedom and ethics. You’ve got our support. As for those critics here who like to use vulgar language and who criticize without reason, they either don’t know their rights, or suffer an intellectual inability to exercise them.
Okay I just spent the last two hours reading all the court documents. Here is my problem/issue: The SFPD is a CITY police department, within the state of CALIFORNIA – they are streching the law saying that because the SFPD receives federal $$$ they get to investigate it??? Let’s predent that’s true…everytime a suspect kicks the window out of a local cop car we can call in the FBI for assistance and circumvent the STATE law and raise issues under Federal Law.

I find it ironic that those posting comments defending “Freedom of the Press” would deny others “Freedom of Thought” – isn’t that the backbone of this entire anarchist movement? Freedom?
I spent a good deal of time on the website – and the one thing I wanted was to understand why Josh wouldn’t turn over the tape – what his philosophy was behind it. I watched the tape and read through a series of articles, but I’m still not understanding his motives. Wouldn’t turning over that tape subject law enforcement to scrutiny as well? The protesters shouts of “police brutality” may have been confirmed by viewing the raw footage as well. What these people did was on public streets – where no “right to privacy” can be implied. So it seems that withholding the tape simply supports the right for protesters to break the law.
How did the destruction of public property – storefronts, newspaper stands, etc. – benefit the anarchist cause? Doesn’t that harm the common people – who are obviously already struggling under the weight of taxes and oppression, according to the footage?
Please understand – I’m not trying to sound judgemental – I would honestly appreciate a better understanding of the logical thought. If someone can present this to me without simply attacking my right to have an opinion, I’d be happy to donate to the legal defense fund.

Nikita, my understanding of the situation is that, on the one hand, there were alleged violations of the law, which have to be proven in court by the police. On the other hand, there was press coverage of said violations.
Where the judicial system is trying to blur the line is in trying to obtain journalistic material in order to demonstrate the violations. The point being that the police did not do it’s job properly and is trying – as it has tried numerous times before – to use material from journalists to compensate for it’s inadequacies in court, thus making journalists de facto police agents and providers of police evidence in court.
It was up to law enforcement agencies to cover the protests and gather evidence that could later be used in court. They miserably failed to do so, and are now ‘fishing’ for other sources.
Looking at related cases over the last 10-20 years shows that law enforcement agencies are more and more bent on intimidating all media from gathering information in an uncontrolled manner. Wars should only be covered by ‘embedded’ journalists, protests should only be covered from assigned coverage points assigned by police, and so on.
Since 2001, a tragedy has become a tool to feed public fear in the United States, and to justify the curtailing of freedom. Bit by bit, the land of the free is becoming the land of the free to think like the state would like you to think.
There’s nothing like feeding the fears of a nation to ensure that it will endorse what would have been unthinkable just a few years ago.

Interesting discussion, some people think that every citizen is obligated to serve as an extension of the government. Well we al know such opions of the communist governments. But you all are of course free to share that opinion. What astonished me was the language some people used to express their opinion, not very civilized.
I read the background of your case and hope some perspective can help you clear your thoughts. I understand at your young age you feel caught between something right (do not disclose) and wrong (disclose), on the premise of journalistic confidentiality. This would apply if you interviewed a whistle blower and need to protect his/her identity. But in your case you videotaped a public area of protesters that turned violent and resulted in fracturing a police officer’s skull. Therefore a serious crime of assaulting an officer has been committed and your tape is material evidence. You should discuss this with your Professor and seasoned news managers. I would not be surprised if they say you should hand over the tapes. I think handing over the tapes is emotionally difficult because it would make you feel like a snitch, and therefore compromise your position next time you videotape something. Keep in mind you were not sourcing a story where the subject requested identity protection. You were taping a public protest that may have captured a crimminal act. Going to jail may help give you publicity, but you need to decide if it’s worth it. If you want to get out of jail, then you’ll need to figure a face saving way out. Look at what Judith Miller did, she said she got consent from the confidential source to okay it. You’ll need to do something similar. Get support from the organization that held the protest. At least they should strongly support your cause, otherwise I think your free to release the tape and move on with your life. If the protesting organization says it’s okay to release the tape, then do so and move on with your life. If they want you to withhold the tape, I would think lesser of them for putting you through jail without properly supporting you. Go to your professor or news agency for support. Just don’t do this alone by yourself. That’s my advice to you if you were my son.

This set of tapes is property, Josh Wolf’s property. Any Legal claim on said tapes is the EXCLUSIVE right of Josh Wolf. No boot on his neck regardless of the weight or texture will change this fact. Josh showed alot of courage the other day and stood up to some bullies. The government has abused is power with this grand jury and has made excuses to for the demanding of the video tape. They say that they are investigating the attempted arson of a police car. But that tape can be used for other purposes such as identifying other protestors in the crowd. The govt. should not be alowed to use the incidents of that night to go on a witchhunt for others. Nor should the power of a grand jury be abused to further other investigations of that night. I believe that Josh knew that these were the real reasons behind the government’s demand for his video and he stood up. I am proud of him for that. I think we all should be. For those who argue about wether Josh should or should not release the tape, I don’t think that’s the point. The point is that no one should be thrown to jail for it, that’s an obvious abuse of power.
However if everybody has to release their tapes to the justice, it is just equivalent has having police cameras all over the street. Big Brother is about to watch us.
I was there when Judge Alsup delivered his verdict. That was a huge shock for me & everyone else who came out to support him. He stood up to the federal government & its movement-destroying weapon-of-choice [grand juries] by refusing to give up his videotapes of the 2005 anti-G8 protest. By putting him in prison, Alsup basically took it upon himself to make an example of my friend. As a warning to other activists to cooperate with anti-activist grand juries.
Josh Wolf did what he thought was right. And became a political prisoner in the process. Meanwhile, real criminals such as rapists, drug dealers, wife-beaters & white-collar/corporate criminals continue to get off either with lighter sentences or scott-free. [In San Frnacisco, child molestors don't get released that easily, but they do get lower bail than, say, someone being arrested/detained for "unlawful assembly"--$500.00.] What’s wrong with this picture?
Anyway, stay strong, Josh. Activists in the San Francisco Bay Area & the world are behind you in this fight. We know that whatever happened to you could very well happen to us. Don’t let the State break you into giving up your 5th & 1st Amendment rights.

Let’s say I have a film of Josh being escorted out of the courtroom and taken to a dark back alley where he is subjected to a severe beating at the hands of some disgruntled police officers. While there are speculations that he didn’t accidently trip over the bar of soap on the prison shower floor there is no other known proof. That is until I post clips of the bloody aftermath of Josh laying in a pool of his own blood on the ground. Now Josh’s family knows there is videotape evidence of what happened to their son. What do you think their next move would be? I could be a jackass and tell his parents he deserved the beating and there was no way I was going to hand over the tape. Or I could do the ethical thing and help his family in every way I could. This doesn’t really come down to a debate about rights. It comes down to a debate about ethics. Between someone that is hiding behind their rights and by doing what is right. I know most of you are all about damning the man and their abuse of power. But think about it for a second. If the situation was reversed and it was a protestor that was severly beaten most of you would be calling for riots and the burning of the San Francisco bridge.

What kind of country do we live in? We live in a country that protects our citizens from both foreign and domestic threats. Josh isn’t the threat, he is protecting it and hiding under false pretenses. Although it is sad he didn’t turn the tape over, this case will help further shape the first amendment by defining what a “journalist” is. Sorry to say when it all boils down, Josh isn’t going to be recgonized as one. But don’t be sad for Josh, he’ll do his time. Josh Wolf is no more of a journalist then Rush Limbaugh. He was not taking this video acting as a journalist, he was making this video to promote his cause. It does not matter how many people view his stuff or buy it. Could be just his mother, or the whole country, if it is for his cause, he is not a journalist. If he does it just to inform his mother, or the whole country, then he is a journalist. Again, it was to promote his cause, he was not acting as a journalist. He was part of the problem, not just recording it, I hope he rots in jail. As a father I understand why his mother would see this differently.
